»The Publication of Vacant Positions in Civil Service Law«: The paper deals with the question of whether a constitutional duty to publicize vacant positions follows from Article 33 (2) of the Basic Law and how such a duty is to be implemented. Without the publication of vacant positions the potential applicant is incapable of applying and cannot exercise his or her rights under Article 33 (2) of the Basic Law. It is shown that public tendering is the only means of guaranteeing equal access to public offices.
